Nick’s clients range from private individuals to substantial national companies and he is regularly involved in the following types of cases: contractual disputes, sale of goods disputes, disputes between agents and principals/buyer and seller/banks and finance companies and their customers, building disputes, disputes arising out of the sale and purchase of companies and businesses (including warranty claims), disputes between Shareholders, partnership disputes, unfair prejudice petitions, disputes about the ownership of land or about rights over land (both commercial land and residential land), disputes between Landlords and their tenants (both commercial and residential), disputes about the validity of wills, or about inheritances or about the administration of estates.

Nick also has substantial experience in commercial fraud cases and professional negligence claims against solicitors, surveyors, and independent financial advisers.

Nick is a member of the Professional Negligence Lawyers Association and the Law Society’s specialist negligence panel.

Important/Significant matters undertaken:

  • Acting for one of the Defendants in a breach of warranty claim worth in excess of £90 million.
  • Acting for a substantial local house builder in defending claims arising out of a joint development project
  • Acting for the Claimant in a high value dispute about fitness for purpose of pipes to be used in the offshore gas/oil industry.
  • Various high value cross-border claims against Dutch, German and Italian companies relating to constructional engineering projects at various English power stations.
  • Acting for a manufacturer/supplier of material handling systems in a dispute with a plastics recycling facility.
  • Acting in various claims brought against insurance companies, for example for the value of a substantial working man’s club in Manchester destroyed by fire and in relation to the prospective total loss of a house on the East Coast through landslip.
  • Acting for the Respondent to an unfair prejudice petition (minority shareholder’s claim) relating to shares worth several million pounds.
  • Claimant’s solicitor in Cottingham and another v Attey Bower & Jones All ER (D) 435 – a ground-breaking solicitors negligence claim.
  • Various claims against solicitors mainly arising out of mistakes made in property transactions but also in relation to poor drafting of option agreements, sale and purchase agreements, shareholders agreements and mistakes made in the conduct of litigation..
  • Acting in a claim against a barrister for a negligent ‘door of Court’ settlement
  • Various claims against surveyors for negligent building surveys/valuations.
  • Acting for a Defendant in a very high value property partnership dispute worth £4-5m.
  • Representing a number of accountancy practices in disputes with their partners
  • Acting for a firm of solicitors with regard to the exclusion from the partnership of one of the partners and resolving all issues arising.
  • Acting against a Baptist Church claiming rights over valuable development land in South Wales.
  • Numerous cases involving claims to property arising on the breakdown of the relationship of people living together.
  • Numerous cases involving disputes between neighbours relating to, for example rights of way, the position of boundaries, boundary structures, building works etc
  • Acting for a large number of local residential flat management companies and thus being routinely engaged to advise on issues relating to residential service charges, repairing obligations, disputes between management company and apartment owner and matters of that nature.
  • Adding a new public footpath to the definitive map for Derbyshire after a claim lasting in excess of 12 years.
  • Numerous cases relating to commercial lease renewals, dilapidation claims, forfeiture.
  • Advising a global mountaineering expedition company about claims against its insurers arising from the evacuation of clients off Mount Everest in the aftermath of the devastating Nepal earthquake of 25th April 2015
  • Representing a Bulgarian Telecommunications Solutions company in a successful claim against an American company relating to a contract to be performed in Spain to which English law applied.
