If you or a relative are, or have been, in a nursing or care home because of physical or mental health needs you may have been paying fees that should have actually been funded by the NHS.
Paying care homes fees
It is assumed that people in care homes automatically have to pay for their own care which is not strictly accurate.
If the persons need for nursing home care is because of a physical or mental need, primary reason, the NHS is responsible for the care home fees. Potentially the cost can escalate into thousands of pounds.
Every person in need of long-term care, because they are ill, should be individually assessed for their medical and health needs first, and not for their ability to pay. This assessment should then be continually reviewed.
If no assessment, or an incorrect assessment, has taken place and as a result you have been paying care homes fees then you may be entitled to reclaim these fees.
