There have been a couple of updates on the Coronavirus Job Retention scheme over the last few days.
Briony McDermott, employment law solicitor at Wake Smith Solicitors in Sheffield, looks at the changes.
She said: “Firstly, the scheme has been extended to 30 June 2020, where it was previously in place until 31 May 2020.
“Secondly, The Employee's Guidance to the scheme has confirmed that it is possible for employees to take annual leave while on furlough, with the employer having to 'top up' to 100% of normal pay.
“The guidance does not state whether an employer can compel an employee to take annual leave while on furlough, however as this is possible under the Working Time Regulations provided adequate notice is given. This is twice the length of leave required to be taken, so two weeks’ notice for one week’s leave.
“So until further clarity is provided on this, it would seem to be business as usual.
“Finally, the Coronavirus Job Retention Scheme portal, allowing employers to reclaim up to 80% of a furloughed employee's salary from HMRC, opened earlier today.”
